Mobal Service Agreement/Terms



RETURNS:

If you're not completely satisfied with the equipment for any reason, return it within 60 days of purchase for a refund. Write to us at returns@mobal.com giving the reason why you are not satisfied, and we will send return instructions. Once we receive the phone, and provided you do not owe us for any calls charges, we will refund the sale price of the phone.

DELIVERY:


Orders must be received by 2pm EST. Not all delivery services are available in all areas. A signature will be required at delivery. Deliveries made to countries outside of the US may be subject to Customs clearance delays, and you may be liable for import duties and taxes - we have no control over these charges and cannot predict what they may be. Missing items from the delivered package must be reported within 7 days of delivery. Re-routing, or cancellation prior to delivery, incurs a charge of $10 per package.

BILLING & CALL CHARGES:


Equipment and shipping charges are taken from your credit card before shipping. You are liable to pay for all calls made and received according to our current tariff, which is available at www.mobal.com/charges.

Call charges are taken from your credit card as and when we receive the call data from the networks. You can then view all the charge detail online at www.mobal.com/myaccount. Due to delays in receiving call data from networks, calls may be charged several months after they were made.

You must inform us of any changes to your credit card details. If we are unable to take payments we may suspend the service until outstanding charges are taken. Our credit card transactions are processed at our billing centre in the UK; Prior to travel you are advised to notify your credit card company to expect charges from the UK.

LOSS OR THEFT:


You are liable for all call charges incurred until you notify us of the loss or theft. To request disconnection of the service call +1 212 785 5800 immediately. This emergency service is available 24-hours a day. Out of normal office hours our answering service will provide instructions.

EQUIPMENT PROBLEMS:


Any problems you have with the equipment must be reported to Mobal as soon as possible. Refunds will not be issued if we were not given the opportunity to solve the problem. We shall not be held responsible for any loss, damage, injury or inconvenience arising from any aspect of our service. We shall not be held responsible for problems relating to the service provided by the phone networks.

REPLACEMENTS:


If there is a fault with the equipment within 12 months of purchase, we will replace it. Please contact us for instructions.

INACTIVITY:


If you haven't used the equipment for more than 18 months, we may temporarily disconnect the service for your security. If you wish to use the service again, simply contact us and we will reconnect the service, free of charge.

TERMINATING YOUR SERVICE:


If you wish to terminate your service, please contact us. You will remain liable for any call charges incurred until the equipment has been disconnected.

RESTRICTIONS:


The Mobal GSM World Phone service is only available for purchase by residents of North America. You are responsible for taking care of the equipment and ensuring that it is used responsibly. You must not transfer the ownership, sell or rent the equipment.

This agreement shall be governed by the laws of New York State. The courts of New York State shall have the non-exclusive jurisdiction to settle any disputes that may arise from or in connection with this agreement. "We" refers to Mobal Communications Inc., "You" refers to the person buying the equipment.

If you have not taken out Theft & Loss Protection, you will be required to pay us the full replacement cost of the equipment.

THEFT & LOSS PROTECTION:


This protects you from the charges that would normally be incurred if your equipment was accidentally lost, stolen or damaged. The Theft & Loss Protection is subject to the following terms:

  • You must report the theft or loss to the Police. You must notify us of the Police Incident Number, the name and telephone number of the Police station, and the date on which the incident was reported. Claims cannot be accepted unless this information is provided
  • You must pay the Theft & Loss Protection Deductible charge within 14 days of the claim being authorized. (Cellular equipment: $40; Satellite equipment: $400.)
  • You must take all reasonable precautions to protect the equipment from theft, loss and damage.
  • The Theft & Loss Protection does not cover the cost of call charges incurred before the theft has been notified to us and the equipment has been suspended from further use.
  • The Theft & Loss Protection does not cover any costs incurred as a consequence of the loss, theft or damage of the equipment.
  • The Theft & Loss Protection does not cover the costs in respect of the following, in which cases you will be required to pay the full replacement costs to Mobal:
    - Theft of the equipment from an unattended motor vehicle
    - Theft or loss of the equipment from an exhibition or trade-show.
    - The non-return of batteries, charging equipment and any other accessories listed on the contract.
    - Loss or damage caused by the wilful act of yourself, your company's employees or any person using the equipment without your permission.
  • This policy shall be void in the event of fraud, non-disclosure or alteration of risk.
  • We reserve the right to cancel the Theft & Loss Protection by sending notice to your address, and in such an event returning the premium for the unexpired period.

RETURNING EQUIPMENT:


You are responsible for returning the equipment to us, simply deposit it with our pre-paid airway bill at any convenient FedEx drop off location. If the package is deposited later than the agreed Rental End Date, additional rental (and optional Theft and Loss Protection) charges will be applied. Early return is non-refundable.

LIABILITY:


You are responsible for taking care of the equipment and ensuring that it is used responsibly. You must not transfer the ownership, sell or rent the equipment. We shall not be responsible for any loss, damage, injury or inconvenience arising from any aspect of our service. We shall not be held responsible for problems relating to the service provided by the phone networks. In the event of the equipment developing a fault during the rental period, contact us immediately and we will try our best to rectify the situation.

CANCELLED ORDERS:


If an order is cancelled you will be charged for any shipping charges incurred and may be subject to an administration fee.

TERMINATION OF CONTRACT:


We reserve the right to terminate the contract at any point, without explanation, and to repossess the equipment, such termination to be effective immediately.
